Subject of the contract

Veltic Send accepts transactional email over an API and hands it to Amazon Simple Email Service for delivery. It is not a marketing platform: there are no contact lists, no campaigns and no bulk sending features.

What you warrant

You warrant that every recipient you send to has either an existing business relationship with you that makes the message a transactional one, or has given the consent that section 7 UWG requires for advertising by email. You warrant that no address in your sending was bought, scraped or otherwise obtained without consent.

• You keep the evidence of consent and produce it on request.
• You indemnify the operator against claims by third parties arising from mail you sent.
• The operator may suspend an account immediately where a bounce or complaint rate endangers the platform.

Sending limits

The service enforces hard limits, both per account and across the platform. Reaching a limit results in a refusal, not in an unexpected invoice. Limits may be raised on request; they are never raised silently.

Availability

The service is provided with reasonable care but without a guaranteed availability figure. Email is inherently a best-effort medium: acceptance by Veltic Send means the message was handed on, not that a mailbox provider will accept or display it.

Liability

The operator is liable without limitation for intent and gross negligence, for injury to life, body or health, and where liability is mandatory by law. For slight negligence the operator is liable only for breach of an essential contractual obligation, and then limited to the damage typical for this kind of contract and foreseeable at the time it was concluded.

Term and termination

The contract runs for a month at a time and may be terminated by either side to the end of a billing period. The operator may terminate without notice where an account is used to send unsolicited mail.

Applicable law

German law applies. Where the customer is a merchant, the place of jurisdiction is the seat of the operator.
